By using this Site and by ordering Goods from this Site you agree, by your conduct, to be bound by these Terms and Conditions. If you do not agree to all the Terms and Conditions you must not, and are not, permitted to use the Site. In addition, if you cannot meet the Terms and Conditions including any preconditions relating to age, then you must not and are not permitted to use the Site.
MODIFICATIONS TO THE AGREEMENT
LIMITATIONS OF USE
You agree that you must not do any of the following while accessing or using the Site:
(a) obtain access to, interfere with, or use without authorisation any non-public areas of the Site, or the computer systems or network owned or used by Dear Mon Cheri;
(b) breach or attempt to breach any security measures of the system or network owned or used by Dear Mon Cheri;
(c) use automated or other means to search the Site;
(d) scrape the Site;
(e) use the Site to send source identifying information including TCP packet headers or email headers which is false or changed; or
(f) interfere with, disrupt or attempt to interfere with or disrupt, the access of any user, host or network, including by sending a virus to, spamming, or overloading the Site, or by scripted use of the Site in such a manner as to interfere with or create an undue burden on the Site.
ELIGIBILITY TO PURCHASE
When placing an Order you:
(a) must provide your name, phone number, e-mail address, billing information and all other information specified in the order form on the Site;
(b) warrant that you are the person referred to in the billing information provided;
(c) expressly authorise Dear Mon Cheri to transmit or to obtain information (including any updated information) about you to or from third parties including information about your credit/debit card number your credit report and credit worthiness, your identity and the authorisation of the transaction; and
(d) warrant that you are over the age of eighteen.
You agree that a contract for the sale of any Goods is only formed when:
– the Goods are available;
– you have placed an Order which complies with these Terms and Conditions, and
– Dear Mon Cheri has accepted the Order and has communicated its acceptance of the Order by confirmation email to you.
You agree that Dear Mon Cheri is under no obligation to accept any Order placed by you.
Whilst Dear Mon Cheri makes every effort to ensure the availability of Goods offered for sale on the Site, Dear Mon Cheri cannot and does not guarantee the availability of Goods at any time. You agree that notwithstanding you may place an Order for any Goods, and Dear Mon Cheri may have communicated its acceptance of such an Order, in the event that the Goods the subject of the Order are not available you have no rights against Dear Mon Cheri in respect of the Order save for a full refund of any amounts which may have been paid by you at the time you placed the Order for the Goods.
Whilst Dear Mon Cheri makes every effort to ensure that delivery times are adhered to, you agree that any delivery time specified in any Order or confirmation of Order is not guaranteed and may be changed in the sole and absolute discretion of Dear Mon Cheri.
You agree that all delivery costs are charged in addition to the price of the Goods the subject of the Order and that delivery costs are as expressly marked at checkout.
Dear Mon Cheri uses reasonable endeavours to ensure that all details, descriptions and prices which appear on the Site are accurate however, errors may occur. If Dear Mon Cheri discovers an error in the price of any Goods that you have ordered, we will notify you immediately and offer you the option to reconfirm your Order at the correct price or to cancel your Order. In the case that we cannot get in contact with you, we will cancel the Order and refund you in full.
The Site may contain errors and inaccuracies and we reserve the right to correct any errors or inaccuracies and to update information at any time without any notice. If an order sent from Dear Mon Cheri to the customer is not delivered for any reason including due to fault of the courier or delivery service, Dear Mon Cheri must, subject the original conditions applicable to acceptance of the Order:
(a) replace the item;
(b) refund the customer in full, or
(c) issue a credit note for the full amount.
Dear Mon Cheri delivers nationwide with Australia Post for a flat rate of $18.00 for all orders under $150. And $0 cost for all orders above $150.
International Standard Shipping: $25.00 (AUD)
International Express Shipping: $45.00 (AUD)
Dear Mon Cheri will work to dispatch the Goods the subject of your Order as soon as possible after acceptance of the Order and will notify you by email with the tracking number of consignment as soon as one is available. Please allow up to 7 business days for delivery in metropolitan areas and up to 10 business days for delivery in remote areas. On a weekend or on a public holiday, the earliest available time for dispatch is the next following business day.
Once Goods have been dispatched, the delivery address cannot be changed so please ensure you have provided the correct details. All deliveries of Goods require a signature upon receipt of delivery so please ensure the delivery address is attended between 9am to 5pm. Deliveries cannot be made to Australian Post Boxes or Parcel Lockers. If you provide a business address for delivery, please specify the name of the business. If no one is available to sign for a delivery, Australia Post will leave an “attempted delivery” card. The parcel will be redirected by Australia Post to your local post office for you to pick up.
The payment methods that we accept are Visa, MasterCard, American Express and PayPal. No Orders will be accepted until payment has been received in full. We may contact you to verify your personal details before dispatching your Goods for delivery.
We may offer promotional discount codes to be used on the Site subject to special conditions specified at the time of issue.
Local Express Shipping (Australia): 1 to 2 business days
International Standard Shipping: 10 to 15 business days (depending on the country).
International Express Shipping: 3 to 5 business days (depending on the country).
Please note, orders of multiple items may be shipped in more than one delivery. this will be indicated by multiple tracking numbers on your shipping confirmation email.
Please note that any extra costs related to import/customs tax are the responsibility of the buyer. Please check your own countries policy on importing goods, as we cannot provide this for you.
Dear Mon Cheri is not responsible for delays in shipping or delivery, due to natural or uncontrollable events. Additionally, Dear Mon Cheri is not responsible for delays related to the courier itself. Unfortunately, we do not have control over these delays. Transit time does not include Saturday, Sunday, or Holidays.
PLEASE NOTE: All the parcels might be delayed due to COVID-19.
Secure Delivery Address
Dear Mon Cheri recommends customers provide a secure delivery address, for example your place of employment. We cannot deliver to PO box or parcel locker addresses. Orders to PO box or parcel locker addresses will be receiving an email to confirm a valid delivery address. Dear Mon Cheri is not responsible for lost/stolen parcels.
Any Goods returned by a customer to Dear Mon Cheri are at the sole risk and cost of the customer. The customer must bear the cost and expense of any loss of or damage to any Goods that are returned. The customer must, and undertakes to ensure, that any Goods returned to Dear Mon Cheri are sent by registered post with an effective tracking facility.
Furthermore, they must satisfy the following conditions:
- The 30 day returns date will start from the date of shipment.
- All labels are still attached on the product (including the care instructions, size tags, and barcode).
- The product has not been worn (except to try on for size).
- The product has not been soiled or damaged.
- The product has not been altered by you in any way.
- The goods are deemed to have a manufacturing fault, assessed by the online.
- Different from a style pictured or described.
- If you are returning an item that is part of an offer such as a 2 for 1 or buy one get one free, the refund amount will reflect the price you have paid on this offer and not based on the original price of the item/s individually.
- Sales items can only be returned for online credit
- We do not accept change of mind returns
To ensure items are fit to be returned, we recommend that you:
(a) do not apply anybody moisturisers before trying clothing on in order to avoid marking leather, silk, suede and other delicate fabrics;
(b) do not let make-up rub off on garments, and
(c) do not allow jewellery to catch on garments.
How to Return Your Order to Dear Mon Cheri
You can return any item within 30 days of purchase if the item is unused with the original tags still attached; see full details of conditions above. and in the original packaging which must be in the original condition. Sale items can only be returned for an online credit.
There are two ways to return your products to Dear Mon Cheri
1. Send the products to us directly
- Download and complete our Return Request Form
- Include a copy of your original invoice and your completed Return Form in your parcel.
- Post it back to Dear Mon Cheri available address in Contact Us Please use the correct payment shipping methods for all returns, as Ally Fashion is not responsible for the return costs.
2. Return with Australia Post
- Create your Return Post Label via Australia Post Returns Portal. You must provide your order number (found on your order confirmation email), reason for returning your item(s), and your details. You will be charged a flat fee of $8.95 to return your items.
- Once you have created your Return Post Label, take note of your return reference number. An email will also be sent to you with this information. This number can be used to track your return via Australia Post.
- Pack all items you wish to return with a complete Returns Formin a satchel, or reuse the original packaging if suitable, and secure the returns label to the outside of the package. Remember to remove any old postage labels if reusing the original packaging.
If you would like to exchange an item for another size please email email@example.com with details of your request. Prior to ordering please check the size guide to ensure that you are purchasing the correct size for you.
Sales items are no available for exchange as we cannot guarantee that another size will be available. We do not accept change of mind returns or exchanges.
For purposes of this Agreement, the term ‘Content’ means a creative expression and includes video, audio, photographs, images, illustrations, animations, logos, tools, written posts, replies, and comments, information, data, text, software, scripts, executable files, graphics, and interactive features, any of which may be generated, provided, or otherwise made accessible on or through the Site. This Site contains material which is owned by or licensed to Dear Mon Cheri. Reproduction is prohibited. Any other use of materials on this Site, including reproduction for any purpose other than personal non-commercial use, modification, distribution or republication, without the prior express written permission of Dear Mon Cheri, is strictly prohibited.
APPLICABLE LAW AND JURISDICTION
You agree that your use of the Site and our Agreement is governed by the laws of the State of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria, Australia in relation to any legal proceeding directly or indirectly arising out of or relating to the Site.
